Acceptance of Terms

By accessing or using our mobile applications available on the Apple App Store and Google Play Store, you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use our apps.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or via email. Your continued use of our apps after such modifications constitutes your acceptance of the updated Terms.

Eligibility and Account Registration

2.1 Age Requirements

You must be at least 13 years old (or the age of consent in your jurisdiction) to use our apps. By using our apps, you represent and warrant that you meet this age requirement.

2.2 Account Creation

To access certain features of our apps, you may need to create an account using Google or Apple OAuth authentication. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Be responsible for all activities that occur under your account

2.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we deem harmful to our apps, other users, or third parties.

License and Restrictions

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our mobile applications on devices that you own or control, solely for your personal, non-commercial use.

3.2 Restrictions

You agree not to:

• Modify, reverse engineer, decompile, or disassemble our apps
• Remove or alter any copyright, trademark, or other proprietary notices
• Use our apps for any illegal or unauthorized purpose
• Interfere with or disrupt the integrity or performance of our apps
• Attempt to gain unauthorized access to our systems or networks
• Use automated systems (bots, scrapers) to access our apps
• Transmit viruses, malware, or other harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations

User Content and Conduct

4.1 User Content

Our apps may allow you to create, upload, or share content. You retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content as necessary to provide and improve our services.

4.2 Content Standards

You are solely responsible for your content and agree that your content will not:

• Violate any intellectual property rights of others
• Contain hate speech, discrimination, or harassment
• Include explicit, pornographic, or inappropriate material
• Promote violence, illegal activities, or dangerous behavior
• Contain false, misleading, or deceptive information
• Violate privacy rights of others

4.3 Content Moderation

We reserve the right, but are not obligated, to monitor, review, and remove any user content that violates these Terms or is otherwise objectionable, at our sole discretion.

Intellectual Property Rights

5.1 Our Property

All content, features, and functionality of our apps, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the overall design and "look and feel" of our apps are owned by Rainbow Unicorn s.r.o. or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Trademarks

"Rainbow Unicorn" and our logos are trademarks of Rainbow Unicorn s.r.o. You may not use our trademarks without our prior written permission.

5.3 Third-Party Services

Our apps integrate with third-party services including Google, Apple, Vultr, Supabase, Mixpanel, and RevenueCat. These services are governed by their respective terms and privacy policies. We are not responsible for the content, policies, or practices of these third-party services.

Payments and Subscriptions

6.1 In-App Purchases

Some of our apps may offer in-app purchases or subscriptions. All purchases are processed through the Apple App Store or Google Play Store and managed through RevenueCat, our in-app purchase and subscription management platform. All purchases are subject to the respective payment terms and refund policies of Apple and Google.

6.2 Purchase and Subscription Management

We use RevenueCat to manage all in-app purchases and subscriptions across platforms. Your purchase information, including transaction history, subscription status, and entitlements, is synchronized through RevenueCat to provide a consistent experience across your devices.

6.3 Pricing

We reserve the right to change our pricing at any time. Price changes will not affect active subscriptions until renewal.

6.4 Refunds

Refund requests are subject to the policies of the Apple App Store or Google Play Store. We do not have the ability to process refunds directly. Please contact Apple or Google for refund requests.

Disclaimers and Limitation of Liability

7.1 "As Is" Basis

OUR APPS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

7.2 No Warranties

We do not warrant that:

• Our apps will be uninterrupted, timely, secure, or error-free
• The results obtained from using our apps will be accurate or reliable
• Any errors in our apps will be corrected
• Our apps will meet your requirements or expectations

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAINBOW UNICORN S.R.O., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use our apps
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our apps
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our apps
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our apps

7.4 Maximum Liability

Our total liability to you for all claims arising out of or relating to these Terms or our apps shall not exceed the greater of €100 or the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Rainbow Unicorn s.r.o. and its officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of our apps
• Your violation of these Terms
• Your violation of any rights of another party, including other users
• Your content or any content that is submitted via your account

Termination

We may terminate or suspend your access to our apps immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our apps will immediately cease.

You may terminate your account at any time by deleting our apps from your devices and discontinuing use. If you wish to have your data deleted, please contact us at privacy@rainbowunicorn.cz.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

10.2 Jurisdiction

Any disputes arising out of or relating to these Terms or our apps shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

10.3 Dispute Resolution

Before initiating any legal proceedings, you agree to first contact us to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations.

App Store Terms

11.1 Apple App Store

If you download our apps from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Rainbow Unicorn s.r.o., not Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for any product liability claims, warranty claims, or intellectual property infringement claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them

11.2 Google Play Store

If you download our apps from the Google Play Store, you agree to comply with Google Play's terms of service and acknowledge that Google is not liable for any claims related to our apps.

General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rainbow Unicorn s.r.o. regarding the use of our apps and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

12.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms without restriction.

12.5 Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation.
